Mining applications | ANM approves new administrative ruling

 

The National Mining Agency (ANM) has approved an important Administrative Precedent regarding the interpretation of Article 31, Paragraph 4, of the Mining Code Regulations.

Under this new interpretation, the submission of a valid and current environmental license for installation or operation—consistent with the Economic Utilization Plan (PAE)—at any time prior to the final administrative decision precludes the rejection of a mining application based solely on the failure to provide periodic proof of the environmental licensing process’s progress.
This measure upholds the substantive purpose of the mining procedure, reduces procedural formalism, and tends to provide greater legal certainty for applicants.
