The Superior Court of Justice (STJ) has established a new understanding regarding the crime of pollution. In Topic 1,377, the Court defined that, in the abstract danger modality, the crime can be proven without technical expertise, as long as the potential risk to human health is demonstrated.
The decision expands criminal action in the environmental area, but emphasizes the need for credible evidence demonstrating this potential, avoiding excessively subjective analyses.
